Family Law: Taping Your Spouse's Telephone is Not a Good Idea

Back in 2005, the Indiana Court of Appeals decided Dommer v. Dommer (pdf format). The trial court decided that a former wife could not sue her former husband for his taping of her telephone calls under either federal or state law. The Indiana Court of Appeals held neither the federal or state statutes allowed a husband to tape his wife's telephone calls without her knowledge. Therefore, wife could sue husband for money damages.
