Indiana Divorce Law: Your Free Online Resources

Attorneys and non-lawyers should know the online family law resources available through the State of Indiana.

  1. Indiana Appellate Opinions. For lawyers, you find here the current slip opinions without West Publishing's headnotes. For non-lawyers: since not all the law is in the statutes or the Rules, you need to take a look here for how the appellate courts interpret the statutes and Rules. For both lawyers and non-lawyers: if you know how to search with Google, then you can handle the archive search. The archives for the
  2. Indiana Child Support Guidelines. The Rules establishing how Indiana courts determine child support. Use with the online child support calculator below. The link I provide is to the html version but there are also versions in pdf and Word (which is also true of the other rules following). You can download these rules (and the others) to a desktop or laptop computer. These do not have links to case law, either. So after reading the Guidelines, you will need to search the case law to find any judicial explanations of the rule.
  3. Indiana Rules of Evidence. Our rules on what evidence is admissible and not, and how to get it admitted. For use in all trial court proceedings including divorces even trial in family court. These do not have links to case law, either. So after reading the Rules of Evidence, you will need to search the case law to find any judicial explanations of the rule.
  4. Indiana Parenting Time Guidelines. The Rules setting out visitation in Indiana.These do not have links to case law, either. So after reading the Guidelines, you will need to search the case law to find any judicial explanations of the rule.
  5. Indiana Rules of Trial Procedure. Here are the rules setting out to do a hearing, discovery, motions and more. Again, these do not have links to case law, either. So after reading the Rules, you will need to search the case law to find any judicial explanations of the rule.
  6. Indiana Rules of Appellate Procedure. These rules apply to appeals from the trial court to the Indiana Court of Appeals and then from the Indiana Court of Appeals to the Indiana Supreme Court. No judicial interpretations are included, so you will need to go the opinion archive to find out how the appellate courts interpret these rules.
  7. Indiana Alternative Dispute Resolution Rules. The rules for mediation are here. If the case goes into mediation, you need to take a look at these.
  8. Indiana Trial Courts and Clerks. I include this because of the range of information available. Select the county you want information for and you will find contact information for the county clerk and the courts of that county and access to the court's local rules (if any).
  9. Indiana Code: FAMILY LAW: DISSOLUTION OF MARRIAGE AND LEGAL SEPARATION. Here is the latest version of the Indiana Code covering divorces. For those looking for guidelines on property divisions, you start here and then go to the cases in my first entry above. TNumbered Listhese pages have no links with the case law.   10. Court Forms. From the Indiana Judicial Center. I have mentioned these before on this blog. Pretty good if you have no kids and everything else is uncontested.
